The Child Visa Subclass 101 and Child Visa Subclass 802 grant special permission to the parents of children younger than 18 years of age to live in Australia as long as their child continues to be an Australian citizen, permanent resident or humanitarian visa holder. If you want to become an Australian permanent resident with your child, this is the visa you want to apply for. There are two ways to obtain Child Visa Subclass 101 802. However, both require starting the process while you live in your home country.
Step 1 - Submit an online application.
To commence the application process, you must visit the Home Affairs website and complete the Form for a Child Visa. You will be required to provide personal details about your child and your background and information on any criminal convictions or prohibitions.
Step 2 - Attach documents.
All applicants should have the following documents ready and uploaded to their One-Form account:
- Copy of Passport with current validity – a page is containing a photograph must be submitted.
- Police Clearance Certificate - Both original and photocopy.
- Certificate of Birth.
- Passport Photos (3) – identical and passport size.
- Photos cannot be dated more than 12 months from the date of application or six months from the date of departure for Australia, whichever is earlier.
- If you are applying from a country other than the U.S., you will need a recent passport photo of you and one photo of your child together.
Step 3 - Validate documents and prepare for an interview
The next step is to validate your documents and prepare for your interview. If you are living outside of Australia, then there will be some additional documents that you will need to prepare as part of the submission process.
Most embassies and high commissions require that you present a letter from the sponsoring company along with an affidavit that includes the sponsor's income statement, showing proof of the sponsor's capacity to fund their dependant's living expenses abroad.
Step 4 - Make sure your child meets all the requirements.
- You can also qualify for a child visa if you're sponsored by someone with whom you have engaged in a business or local employment relationship. However, you cannot be an employee of the person sponsoring you.
- To obtain the visa, your sponsor must show evidence of having enough money for the sponsorship and provide assurance that they will be able to support themselves and the applicant during their time in Australia.
Step 5 - Attend an interview and get approval.
Now that you have filled out the online application, submitted your supporting documents, and met the Child Visa Sublevel eligibility requirements, it is time to attend your visa interview. Get ready to answer some questions about your residence in Australia and how long you will be there. Your interviewer will also likely ask what you plan on doing in Australia.
